Government issues guidance for councils on fly-tipping

Two government departments have issued guidance for local authorities on fly-tipping and the penalties they can charge.

The guidance from the Department for the Environment, Food and Rural Affairs and the Department for Communities and Local Government covers:

  • Councils’ responsibilities: assessing the incident; fly-tipping on land; fly-tipping in water
  • Investigations, penalties and prosecution: preliminary investigations; full investigation; penalties and notices; prosecutions
  • Claiming costs
  • Preventing fly-tipping.
